Crash Pad Rentals

This Rental Pad Waiver and Release of Liability Agreement ("Agreement") is entered into between Berkshire Boulders ("Company") and the undersigned renter ("Renter") in connection with the rental of a crash pad and/or associated equipment ("Equipment"). 1. Assumption of Risk. Renter acknowledges that use of the Equipment for bouldering, climbing, or related activities involves inherent risks, including but not limited to physical injury, property damage, and death. Renter voluntarily assumes all such risks. 2. Release of Liability. Renter, on behalf of themselves, their heirs, executors, and assigns, releases and forever discharges Company, its owners, employees, and agents from any and all claims, demands, or causes of action arising out of or related to the use of the Equipment, except to the extent caused by Company's gross negligence or willful misconduct. 3. Condition of Equipment. Renter agrees to inspect the Equipment before use and to return it in the same condition as received, ordinary wear and tear excepted. Renter is responsible for the full replacement cost of the Equipment if lost, stolen, or damaged beyond ordinary wear and tear during the rental period. 4. Rental Period & Fees. Renter agrees to return the Equipment by the end of the rental period stated below. Late returns may be subject to additional fees as set by Company. 5. Acknowledgment. Renter certifies that they are at least 18 years of age (or that this Agreement is signed by a parent/legal guardian on behalf of a minor Renter), that they have read this Agreement in its entirety, understand its terms, and sign it voluntarily.
